According to the Act, the person nominated to fill a casual vacancy in the KSPCB shall hold the office only for the remainder of the term of the member in whose place he was nominated.

Thimmaiah was filling in for the remaining term of N Jayaram who was appointed as a chairman of the board in 2019. However, Jayaram resigned within three months thereby creating a casual vacancy. After his resignation, five people had served in the post till Thimmaiah was appointed in November 2021.

While he was to serve for the remainder of the months, Thimmaiah was given a fresh tenure of three years by the then BJP government in the state in violation of the Water (Prevention and Control of Pollution Act).
